Privacy Statement for Applicants
McDonald’s Restaurants Belgium NV, with registered office in Belgium, 1831 Diegem, Leonardo Da Vincilaan 19 (Airport Plaza, Stockholm Building, 5th Floor) and registered in the Crossroads Bank of Enterprises under number 0417.475.429 (referred to as “McDonald’s”, “we”, “us” or “our”), is committed to protecting the privacy and security of the information that we collect and use for hiring related purposes and for the administration of our human resources functions in preparation for an employment relationship. McDonald's is a subsidiary of the corporate group (referred to as “McDonald’s Group”) controlled by McDonald's Corporation, headquartered in Chicago, Illinois (referred to as “McDonald’s Corp”), also including other wholly-owned subsidiaries (each referred to as “McDonald's Group Entity”).
1. Scope
This statement explains how McDonald’s manages the personal information of applicants.
2. Who is the Data Controller
For the purposes of this Statement, McDonald’s is the data controller of your personal data.
3. Information We Collect
This Statement applies to personal information (i.e., any information relating to an identified or identifiable natural person) of applicants. The actual personal information collected and processed will vary depending on the role and position you apply for and whether your application is successful. This information may be provided by you to McDonald’s, internally generated by McDonald’s, or may be provided to us by current/former employers or by third parties for the purposes of the application/hiring process.
In the normal course of the application process, we may collect and process the following type of personal information on the legal bases set out below under Section 5 and to achieve the purposes set out below under Section 4:
- Contact information (e.g. your name, home address, home number, mobile number, and email address);
- Login data for our hiring platform (e.g. usernames and passwords);
- Your biological gender, date of birth and age, marital status, birthplace, nationality, residency and work permit status, other information needed in order to comply with local legislation;
- Information on former job positions, employment history, and other application related data (e.g. description of current and past titles/positions grade or level, unit/department, technical skills and training courses attended, education, academic title, other achievements, locations, photograph, other information related to your work history, military service, professional certifications, language capabilities and other relevant skills, references, letters of recommendation and interview notes, development plan and willingness to relocate, your date of application, and other information you provide to us in your application).
Only for applicants applying to certain positions and in exceptional cases to the extent necessary for the purposes set out in the next section below:
- Where permitted by applicable law and proportionate in view of the function to be carried out by a prospective employee, the results of credit and criminal background checks, and other screening procedures.
4. Purposes for Which Your Personal Information is Processed
We collect and use personal information for a number of purposes related to the application and hiring process:
- Staffing extension and general strengthening of workforce;
- Evaluation, planning and workforce management (e.g. decision-making; succession planning; business continuity);
- Application & recruitment management (e.g. the administration of your application);
- Transition purposes (e.g. transitioning from application to hiring and employment);
- Legal and compliance purposes (e.g. fulfilling recording, information and reporting obligations and otherwise complying with applicable legal requirements, and ensuring compliance with internal policies and procedures, managing any internal complaints and ethics issues);
- Resolving disputes (e.g. dispute and complaint resolution; internal investigations and reviews; auditing; compliance and risk management; judicial or administrative orders; legal claims);
- Compliance with our inclusion initiatives and strategies;
- Enabling and facilitating communication (e.g. electronic and video communication);
- Security & risk prevention (e.g. protecting systems and facilities; audits; investigations; risk management).
To the extent any envisioned use is inconsistent with or outside of the above contemplated uses in this Statement, we will communicate it to you at the point of collection. Providing your data is voluntary, but without it we may not be able to process and consider your application.
5. Legal Bases of the Processing
We process your personal data on the following legal bases under the General Data Protection Regulation (“GDPR“):
- We process some of your personal data to take steps prior to entering into an employment contract (Article 6(1)(b) GDPR) with you;
- We process some of your personal data on the basis of our overriding legitimate interest (Article 6(1)(f) GDPR) which is to achieve the purposes set out above under Section 4; and
- We process some of your personal data on the basis of the necessity to comply with legal obligations to which we are subject (Article 6(1)(c) GDPR), e.g. as employment law related obligations, tax law related obligations, and social security law related obligations.
6. How We Disclose and Share Your Information
Your information may also be shared with third parties outside of the McDonald’s Group for the purposes set out further above Section 4. These third parties may include:
- Third party service providers, including suppliers, subcontractors and consultants that provide services to McDonald’s, McDonald’s Group Entities, McDonald’s Corp., or the McDonald’s Group; and
- Government authorities, including regulatory authorities, law enforcement, or public entities.
7. International Data Transfers
Like many global businesses, we centralized and outsourced certain processes to manage applications, hiring and onboarding. To provide these services, it may be necessary to transfer your information outside of the country where it was originally collected or outside of your country of residence.
We only transfer your personal information to a non-EU/EEA country where an adequate level of data protection is ensured, in particular by way of entering into appropriate data transfer agreements based on Standard Contractual Clauses (e.g., Commission Implementing Decision (EU) 2021/914) and other suitable measures which are accessible from us upon request.
8. Market Visibility
Your information will be visible to several or all recruiters within McDonald’s Group, ("Market Visibility"), if you ask for this by selecting the respective check boxes.
- If you select "Any company recruiter worldwide", your personal data will be accessible to the recruiters of any entities within the McDonald's Group worldwide.
- If you select “Any company recruiter in my country/region of residence”, your personal data will be accessible to the recruiters of any entities within the McDonald's Group in the country/region of your residence if applicable.
- If you select “Only recruiters managing jobs I apply to”, your personal data will be accessible only to the McDonald's recruiter(s) managing applications for jobs that you have applied for.
You may change your visibility settings at any time.
9. Retention
McDonald’s will only retain your personal information for the duration of time necessary to fulfill the purposes described in this Statement and to adhere to our policies on maintaining records (unless a longer period is needed by law). This may include retaining your personal information for a period of time after a decision on your application or in cases of successful applications, even following termination of your employment relationship with us, in particular where potential legal claims are not yet time-barred.
10. Choice, Access, Portability and Other Rights
We want to ensure that you have the necessary tools at your disposal to control the information that you provide to us. It is also important that you contact us to keep your information accurate and up to date.
Under applicable law, you may have the rights (under the conditions and to the extent set out in applicable law): (i) to check whether and what kind of personal information we hold about you and to access or to request copies of such data; (ii) to request correction, supplementation, anonymization, blocking or deletion of information about you that is inaccurate, incomplete, outdated, unnecessary, excessive or processed in non-compliance with applicable requirements; (iii) to request the restriction of the collection, processing or use of information about you; (iv) in certain circumstances, to object for legitimate reasons to the processing of your information or to revoke consent previously granted for the processing while the latter does not affect the lawfulness of processing before the revocation; (v) to request data portability; and (iv) to lodge a complaint with the competent authority.
